Terms of Service

These terms are an agreement between you and Tailored Surveys, Inc. (“we”, “us”) for your use of the Vibe Check website, API and connector (the “Service”). By creating an account or using the Service you agree to them. Our Privacy Policy explains how we handle your information.

1. Who can use the Service

You must be at least 18 years old and live in the United States. You must give an email address you control and keep your password and API keys confidential. You are responsible for activity under your account, including what an AI agent does with credentials you give it.

2. What the Service does

You answer survey questions; an AI agent you connect predicts your answers; we compare them and show you the results. Scores are for information and entertainment. They are not advice and are not a complete or authoritative measure of you or of any AI product.

3. Your AI agent

AI agents and the platforms they run on, including Meta's Muse, are third-party services that we do not control and are not responsible for. We are not affiliated with, sponsored by or endorsed by Meta. Your use of an agent is governed by your agreement with its provider. You can revoke an agent's access at any time from your account page.

4. Acceptable use

You agree not to: create accounts by automated means or for other people; submit answers you know to be false in order to distort results; interfere with, probe or overload the Service; access data that is not yours; or use the Service in violation of law. We may rate-limit, suspend or close accounts that break these rules.

5. Your content and our data

You keep whatever rights you have in your answers. You grant us a worldwide, royalty-free licence to store, process and analyze your answers and your agent's predictions in order to operate and improve the Service, and a perpetual, irrevocable licence to use, publish and commercialize information derived from them in aggregated or de-identified form. This does not limit your rights under the Privacy Policy, including your right to delete your personal information.

The Service itself, including the survey questions, software and design, belongs to us and is licensed to you only for personal, non-commercial use of the Service.

6. No payment

The Service is currently free and we do not pay for participation. If that changes we will present additional terms first.

7. Ending your use

You can stop using the Service and delete your account at any time. We may suspend or end the Service, or your access to it, at any time; where practical we will give you notice and the chance to download your data first.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that results will be accurate.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to US $100. Some jurisdictions do not allow these limits, so some of them may not apply to you.

10. Governing law and disputes

These terms are governed by the laws of the State of [STATE OF INCORPORATION], without regard to conflict-of-law rules. Courts located in that state have exclusive jurisdiction over disputes, except that either party may bring an individual claim in small-claims court where it qualifies.

11. Changes

We may update these terms. If a change is material we will notify you by email or on the Service before it takes effect. Continuing to use the Service after that means you accept the updated terms.
